Metal Company Pays Bellmawr Boro $16K to Settle Lawsuit; A Municipal Line & Supports Were Damaged in Collision

Bellmawr Borough has agreed to settle a lawsuit for $16,000 that was filed against Camden Iron Metal and two other defendants. A truck that was overloaded with scrap metal collided with an overpass and damaged a municipal water line and supports.

The Borough of Bellmawr has accepted $16,000 to settle a lawsuit that was filed against Camden Iron Metal Co. and two other defendants. According to the allegations contained in the Complaint filed by Borough attorney, Robert Messick, a truck driven by a Camden Iron Metal employee in early 2017 was overloaded and its cargo of scrap metal not secured when it collided with the overpass over New Jersey State Highway 42, at or near mile post 14.1.

This caused “great damage to the Bellmawr Municipal water line and its supports,” the Complaint alleged. “This collision and resulting damage were a direct and proximate result of the negligent overloading and failure to secure a cargo of scrap by the employees and agents of Camden Iron and Metal Co.”

The Borough demanded judgment in the amount of $15,294.03.

The case recently settled for $16,000, according to a letter that Messick filed with the Court on April 30, 2018. “The Borough of Bellmawr received a check in the amount of $16,000 from Camden Iron & Metal Company on February 16, 2018, which the Borough acknowledges is a full and satisfactory settlement of the Borough’s claims. The Court should mark the case as settled and the complaint dismissed,” the letter read.
