Personal Injury From Fall

A Camden County woman has filed a lawsuit in Camden County Superior Court against a local tree service alleging that she was caused to fall in mid-2021 and suffer permanent injury as a direct consequence of a dangerous condition created by the tree service.

The plaintiff states in her Complaint that the defendants and their employees, allegedly broke a storm sewer cover, and without repairing it or warning anyone of the condition, placed the broken pieces back over the hole so that it appeared intact.

The plaintiff, not realizing that the defendants allegedly concealed the defect, stepped on the storm drain cover, which collapsed, and then the plaintiff fell into the drain.

As a result of the defendant’s alleged carelessness and negligence, the plaintiff states that she has been caused to suffer severe and permanent injury, was required to seek medical attention for her injuries, and will in the future incur additional medical expenses.

Plaintiff alleges to suffer from great pain and humiliation from her injury and has incurred bills and expenses for her medical care and treatment.

Plaintiff also claims to have suffered earnings loss and earning capacity.

The plaintiff demands judgment against the defendant for damages together with interest and costs of suit.

As a result of the collision, the minor plaintiff was violently thrown and suffered severe painful bodily injuries, all or some of which, may be permanent in nature and will in the future cause her great pain and discomfort.

The lawsuit seeks damages, interest, attorney’s fees, and costs of suit.

The Complaint alleges that the hospital had a duty and obligation to keep said premises properly maintained and safe.

The Complaint alleges that as a result of the carelessness and negligence of the defendants, the plaintiff, sustained severe personal injuries of both a permanent and temporary nature, has been and will in the future be forced to endure great pain and suffering, and has been and will in the future be forced to incur medical expenses in the care and treatment of said injuries, and has been and will in the future be unable to continue with her normal course of activities.

The Complaint states that the hospital failed to warn of existing dangerous existing conditions, failed to put up warning signs that the dangerous conditions existed, and also failed to abate the hazards.

The Complaint also outlines allegations against John Doe defendants, (whose identities are presently not known) that those defendants were also negligent in the supervisory maintenance, repair, and general safekeeping of the business.

The Complaint alleges that because of those dangerous and hazardous conditions on the premises, the plaintiffs have suffered great pain and discomfort, were compelled to expend certain sums of money in an attempt to cure and alleviate their injuries, and have been unable to pursue their normal activities, including their occupations resulting in loss of wages.
