43-Year-Old Atlantic City Man Sentenced to State Prison On Gun Case

Police also recovered 20 wax paper envelopes later confirmed to be heroin and fentanyl on Emmanuel Diaz’s person during arrest.

On January 4, 2023, Emmanuel Diaz, 43, from Atlantic City, was sentenced by the Honorable Bernard E. DeLury, Jr., P.J.Cr,. in accordance with the State’s recommendation of a three-year New Jersey State Prison term with a parole ineligibility period of one year pursuant to the Graves Act for third-degree Unlawful Possession of BB gun.

Diaz was also ordered to forfeit the weapon.


On January 2, 2021, Atlantic City Police witnessed Diaz walking in the area of South Montpelier Avenue in Atlantic City. Patrol observed Diaz make eye contact with them and then place what appeared to be a semi-automatic black handgun into his front pocket.

Patrol made contact with Diaz and recovered the weapon during a search incident to arrest. The firearm was later identified as a black plastic semi-automatic BB gun. Police also recovered 20 wax paper envelopes later confirmed to be heroin and fentanyl on Diaz’s person during arrest.

Assistant Prosecutor Ryan Jones represented the State in this matter.
