A Legal Notice was published on January 25, 2019, stating that the New Jersey Department of Environmental Protection (Department/NJDEP) has advertised a Public Notice proposing a Renewal Permit Action for a New Jersey Pollutant Discharge Elimination System (NJPDES), in accordance with State statute and by authority of the Water Pollution Control Act.

The discharge permittee facility is Sunoco Partners Marketing & Terminals, LP Sunoco Partners Marketing & Terminals, LP Eagle Point Facility, 1240 Crown Point Road in Gloucester County.
The Legal Notice reads: “The facility is classified as a major discharger by the Department in accordance with the USEPA rating criteria. The facility was formerly an operating petroleum refinery, but all refining production activities permanently ceased in November 2009. The facility no longer processes crude oil and has dismantled all processing equipment at the facility. The facility now operates as a tank farm and sales terminal. Products stored at the facility include but may not be limited to gasoline, middle distillates, residual fuel and petrochemicals. Operations that are currently in service include the cogeneration facility, boilers A, B, & C, certain storage tanks, and the wastewater treatment plant.”
Additionally, “During the time period of March 2012 through February 2017, the facility’s combined long-term average flow for DSN 001A, DSN 003A and DSN 004A was 0.93 MGD, while the daily maximum flow was 5.11 MGD. The facility also has four regulated stormwater only outfalls, namely DSN 005A, DSN 010A, DSN 014A, and DSN 017A. Wastewater treatment at the facility includes oil and water separation by an API separator, two parallel aeration basins, two clarifiers, three parallel sand filters, ultraviolet disinfection and a biosludge thickener. The plant’s design capacity is 5.0 MGD and a current average flow of 0.74 MGD is discharged from DSN 001A to Zone 4 of the Delaware River.”

A draft NJPDES permit renewal has been prepared for this facility based on the administrative record, which is on file at the offices of the Department, located at 401 East State Street, Trenton, New Jersey.
It is available for inspection, by appointment, Monday through Friday, between 8:30 A.M. and 4:00 P.M. Appointment for inspection may be requested through the Open Public Records Act office.

Written Comments/Request for Public Hearing:
Written comments or a request that the Department hold a non-adversarial public hearing on the draft document must be submitted in writing to Susan Rosenwinkel, Acting Bureau Chief, or Attention: Comments on Public Notice NJ0005401, at Mail Code 401-02B, Division of Water Quality, Bureau of Surface Water Permitting, P.O. Box 420, Trenton, NJ 08625-0420 by the close of the public comment period, which closes thirty calendar days after publication of this notice.
All persons, including the applicant, who believe that any condition of this draft document is inappropriate or that the Department’s decision to issue this draft document is inappropriate, must raise all reasonable arguments and factual grounds supporting their position, including all supporting materials, during the public comment period.
The Department will respond to all significant and timely comments upon issuance of the final document. The permittee and each person who has submitted written comments will receive notice of the Department’s permit decision.
